Patna(Magnificent Bihar): Construction work on the much-hyped beer factory of the Vijay Malaya’s owned United Breweries group in Naubatpur, about 20 km from here, has been stayed by the Patna High court. The court has passed stay order in the wake of a bunch of petitions filed by the farmers, whose land had been acquired for public purpose in 2008 and being utilised for constructing beer factory by an influential industrialist Vijay Malaya.
A division bench of the Patna High court, comprising justice P C Verma and Justice Amanullah on the plea of the petitioners, requesting the court to quash the land acquisition and subsequent transfer of the land, measuring over 13 acres of 27 farmers to the United Breweries group, for setting up beer factory. Work on construction of the factory was going on in full swing.
According to Ambuj Narayan Choubey; the court had stayed the construction work till further directive taking into account the provisions of the Articles 47 and 21 of the Constitution. The court has fixed March 24, 2012 as next date of hearing of the case. Acquired land of farmers, measuring 42 acres belonged to 13 farmers of Naubatpur village areas, had been transferred to UB group.
Counsels of a group of farmers have submitted before the court that the Bihar government had acquired the land for public purpose under emergency sections of the Land Acquisition Act. Choubey stated before the court that setting up beer factory could not be termed as public purpose. The court has asked the Bihar government to explain the situation whether setting up of beer factory could be called a “public purpose factory”.
Appearing on behalf of the state government, additional advocate general Lalit Kishore informed the court that the Bihar government had acquired land for setting up industrial units in the areas as the state was lagging far behind on industrial front in the country. “A industry whether of beer or any other purpose in the country be termed public purpose,” Kishore added.
The court later took note of the Article47 of the constitution, which says about prohibition of the consumption excepts for medical purpose of intoxicating drinks and of drugs , injurious to health. Article 21 says no person shall be deprived of his pertsonal life and liberty except according to procedure established by the law, which Choubey had submitted.


























Most corrupt society in India is court it high time to clean this jerk or be ready to face jerk. Judges might be looking for a good chunk of pie from Vijay at the expense of Bihar development. These judge community can lick anything for their personal benefit and always ignored national interest. This present government can not eradicate this problem we need more and more person like Anna Hazare.
